By accessing or using Loopsy.ai ("the Platform," "we," "us," "our"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Platform.

 
2. Description of Services
Loopsy.ai is an online advertising platform that connects advertisers with publishers. Advertisers can create campaigns to acquire engaged newsletter subscribers, and publishers can promote these campaigns and earn revenue for valid, engaged referrals.

 
3. User Eligibility
To use Loopsy.ai, you must:

Be at least 18 years old.
Have the legal capacity to enter into binding contracts.
Comply with these Terms and all applicable laws.
 
4. Account Registration
Users must provide accurate, current, and complete information when creating an account.
You are responsible for maintaining the confidentiality of your account information.
You must immediately notify us of any unauthorized access or use of your account.
 
5. Data Collection and GDPR Compliance
5.1 Data Collection
We collect and process the following data:

Personal identification information (name, email, contact details).
Payment details processed via third-party providers like Stripe.
Campaign data, including subscriber engagement metrics.
5.2 Data Usage
Your data is used to:
Facilitate campaign creation and management.
Process payments and disbursements.
Communicate with you regarding updates and relevant platform information.
Improve the Platform and user experience.
5.3 Data Storage
Personal data is securely stored on encrypted servers within the European Union (EU).
Data is retained only as long as necessary to fulfill legal, operational, or regulatory obligations.
5.4 GDPR Rights
As per the General Data Protection Regulation (GDPR), you have the right to:
Access your personal data.
Request correction or deletion of your data.
Object to or restrict the processing of your data.
Request data portability.
Withdraw consent at any time where processing is based on consent.

6. Payment Terms
6.1 Advertisers
Advertisers must provide a valid payment method via Stripe.
Advertisers are only charged after engagement is verified.
Failed payments must be resolved within 7 days to avoid campaign suspension.
6.2 Publishers
Publishers will receive automated payouts after engagement is verified.
Payouts are made via third-party payment processors.
Loopsy.ai is not liable for delays caused by third-party providers.
Fraudulent engagements will result in forfeiture of earnings.
6.3 Third-Party Payment Providers
Payments are processed via third-party platforms (e.g., Stripe).
Loopsy.ai is not responsible for third-party payment issues, processing delays, or payment errors.
 
7. Fraud Prevention
7.1 Advertisers
Advertisers must create campaigns in good faith and ensure that engagement goals are authentic.
7.2 Publishers
Publishers must promote campaigns ethically and avoid fraudulent activities, including:

Using bots or automated systems to inflate engagement.
Engaging in misleading or deceptive practices.
Generating false or self-referrals.
Fraudulent behavior will lead to immediate account termination and forfeiture of earnings.
 
8. Prohibited Conduct
You agree not to:

Use the Platform for any illegal or fraudulent purpose.
Misrepresent information or mislead other users.
Attempt to gain unauthorized access to systems or data.
Interfere with the proper functioning of the Platform.
Violate the rights of third parties, including intellectual property rights.
 
9. Intellectual Property
All content, trademarks, and designs on Loopsy.ai are the exclusive property of the company.
Users retain rights to their original content but grant Loopsy.ai a license to use it for Platform operations.
 
10. Limitation of Liability
Loopsy.ai is not liable for indirect, incidental, or consequential damages arising from your use of the Platform.
We do not guarantee continuous or error-free access to the Platform.
We are not liable for failures or delays caused by third-party services, including payment processors.
Total liability is limited to the amount you paid for services in the previous six months.
 
11. Disclaimers
Loopsy.ai does not guarantee engagement outcomes or campaign performance.
The Platform is provided "as-is" without warranties of any kind.
Users are responsible for ensuring their campaigns comply with applicable laws and regulations.
 
12. Termination
Loopsy.ai reserves the right to suspend or terminate accounts that violate these Terms.
Termination may occur without prior notice for serious violations, including fraud.
Users may request account closure at any time by contacting founders@loopsy.ai
 
13. Dispute Resolution
All disputes must first be attempted to resolve through mutual negotiation.
If unresolved, disputes will be submitted to arbitration in the Netherlands.
Each party is responsible for its own legal fees unless otherwise determined.
 
14. Changes to Terms
Loopsy.ai reserves the right to modify these Terms at any time.
Changes will be communicated via email or through the Platform.
Continued use of the Platform after updates signifies acceptance of the new Terms.
 
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
